Terms of Service

1. Operator

These Terms of Service (“Terms”) govern access to and use of the Ava SMS assistant and the website at ava.phiunit.com (collectively, the “Service”). The Service is operated by Phi Unit Research Partners Inc, a private corporation doing business as “Phi Unit” (“Phi Unit,” “we,” “us,” or “our”).

2. SMS terms (consumer)

By opting in to SMS from Phi Unit Research Partners Inc — including by submitting a mortgage inquiry form on a Broker client’s website or Meta lead form — you agree to receive text messages related to your mortgage inquiry, requested follow-up, customer care, and appointment scheduling. Each message identifies the Broker you signed up with.

Message frequency varies based on your interaction. Message and data rates may apply. Reply STOP to opt out of further messages. Reply HELP for help. Consent is not a condition of purchase.

Phi Unit Research Partners Inc does not sell, rent, or share your mobile information or SMS consent with third parties or affiliates for their marketing or promotional purposes.

3. Use of the Service (Brokers)

If you are a mortgage broker, lender, or other commercial customer using the Service to follow up with consumer leads (a “Broker”), you represent that you have the legal authority to engage Phi Unit Research Partners Inc to send SMS messages on your behalf and that all consumer phone numbers submitted to the Service were collected with valid express written consent under TCPA, CTIA, and applicable state law.

4. Acceptable use

You may not use the Service to send unsolicited marketing messages, content prohibited by carrier policies (the “SHAFT” categories — Sex, Hate, Alcohol, Firearms, Tobacco — gambling, illegal services, or high-risk financial offers), or any content unlawful in the recipient’s jurisdiction.

5. Intellectual property

The Service, including the Ava software, branding, and website content, is the property of Phi Unit Research Partners Inc and its licensors. No license is granted except as expressly set forth in a written agreement with Phi Unit.

6. Disclaimer & limitation of liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Phi Unit Research Partners Inc disclaims all warranties, express or implied, and shall not be liable for indirect, incidental, special, consequential, or exemplary damages arising from use of the Service.

7. Changes

We may update these Terms from time to time. The current version will always be available at this URL with the effective date shown above.
